臺灣博碩士論文加值系統

中國 2021 年公告「進口食品境外生產企業註冊管理規定」，規定出口至中國的食品製造加工業者，皆需向中國海關總署申請註冊，而多數業者對中國食品法規不清楚，造成所提供之文件無法符合中國要求而被退件，本研究探討兩岸食品安全法規差異並參考 CAC 標準；依據食品退件比率統計，分析其退件原因，且探討中國進出口管理規定對各國貿易額之影響，以及分析其管理規定是否符合 WTO/SPS 規範。
結果顯示，食品法規部分臺灣在製程管制、清潔消毒管理、監督管理是低於 CAC，應加強管理；病媒管制與運輸管制中國規範較 CAC嚴格，而人員衛生管理、產品標示內容物名稱、食品添加物限量、檢驗項目規範，臺灣須符合中國之規範。推薦註冊退件原因，主要與兩岸檢驗限量標準不同有關，其次為衛生規範差異，而特殊膳食用食品、食用植物油、乾果類，需注意兩岸類別定義之差異，而自行註冊退件原因，主要與產品加工流程圖完整正確性有關。根據中國海關總署各國輸銷中國食品總值，臺灣、加拿大、西班牙、美國在 2023 年出口中國的食品總值皆下降，但泰國、越南、印尼、韓國等國的食品出口總值卻是上升的，推測這些國家較能適應遵守新規定，且當地主管機關對於推薦註冊文件在審核時，較為嚴謹能正確提供中國所要求之文件，另外，以 WTO/SPS原則分析中國進口食品管理規定，針對高風險食品的類別訂定依據應提供相關科學依據，且應公開檢驗檢疫標準和程序， 以提高貿易透明度。
綜合上述結果，在兩岸食品法規差異部分，對於低於 CAC 之規範，臺灣應加強管理，且須特別留意須符合中國規範之項目；臺灣出口中國食品可能退件原因，主要在於微生物、重金屬檢驗項目限量標準、衛生規範；依據各國輸銷中國食品總值，中國進口規定並非對所有國家皆產生負面影響，因此，臺灣主管機關在審核時，應確保推薦註冊之文件是符合中國之規範以減少退件率；而中國進口食品管理規定在基礎上是依照 WTO/SPS 協定制定，但是針對高風險產品之風險科學依據應更為明確。

In 2021, China introduced the "Administrative Provisions on Registration of Overseas Manufacturers of Imported Food," requiring food exporters to register with China. Many businesses unaware China's food regulations, leading to documentation rejections. This study examines cross-strait food regulation differences, referencing CAC standards, and analyzes the reasons for rejected and the impact of China's regulations on international trade. Also evaluates compliance with WTO/SPS standards.Results show that Taiwan's standards like process control and sanitation are below CAC standards need improvement, while China's regulations are stricter in pest control and transportation. Taiwan must comply with Chinese regulations such as hygiene management, labeling, and testing standards. Rejections are due to differences in testing limits and hygiene standards, special dietary foods, vegetable oils, and dried fruits require attention to the differences in category. The accuracy of processing flowcharts is factor in self-registration rejections. According to the value of food exports to China in 2023, food exports to China from Taiwan, Spain, and the US decreased, while exports from Thailand, Vietnam, Indonesia, and South Korea increased, likely due to better adaptation to the new regulations, and their local authorities are more rigorous in reviewing the recommended registration documents. China's import regulations, while based on WTO/SPS principles, require clearer scientific evidence for high-risk food categories and greater transparency in inspection procedures.In conclusion, Taiwan should enhance regulations that fall below CAC standards and ensure compliance with Chinese regulations. Key reasons for rejection include noncompliance with microbial, heavy metal standards, and hygiene regulations. As China's import rules affect countries differently, Taiwan must meet these requirements, and the scientific basis for high-risk products in China's regulations should be clearer.
